These Terms of Use ("Terms") govern your access to and use of the Align mobile application and related features (the "Service"). By using Align, you agree to these Terms.
Acceptance of These Terms
By downloading, accessing, or using Align, you agree to these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
Align is operated by Alisher Abdulin. These Terms govern your access to and use of the Align mobile application and related services.
These Terms of Use ("Terms") govern your access to and use of the Align mobile application and related services (the "Service").
Your use of Align is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
1. Eligibility
Align is not directed to children under 13. Users under 13 years of age are not permitted to use Align.
If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian.
By using Align, you represent that you meet these age requirements.
2. What Align Does
Align is a screen-time and habit-building app designed to help you use your phone more intentionally.
Depending on the permissions you grant, Align may:
- protect selected apps or categories
- interrupt access before a protected app opens
- require habit sessions before access
- let you convert earned energy into limited unlock time
- support streaks, progress, and related in-app summaries
- send optional reminders and local notifications
3. Apple Features and Permissions
Some Align features depend on Apple services and permissions, including Screen Time, Family Controls, Managed Settings, Device Activity, notifications, and app extensions.
If you deny, remove, or limit those permissions:
- parts of Align may not work
- interruptions, app shields, usage reporting, or unlock behavior may be limited
- some product features may behave differently depending on iOS rules or system state
You understand that certain parts of the Service rely on Apple-controlled platform behavior that we do not fully control.
4. Your Responsibilities
You agree to use Align lawfully and responsibly. You may not:
- use the Service in violation of applicable law
- interfere with, disrupt, or misuse the Service
- attempt to reverse engineer or bypass app protections beyond what law permits
- use the Service in a way that harms other people, devices, or networks
5. No Medical or Therapeutic Advice
Align is provided for personal awareness, productivity, and habit support only. It is not medical, psychiatric, psychological, or therapeutic advice, and it is not a substitute for licensed professional care.
6. No Guarantee of Results
Align is designed to support more intentional phone use, but we do not guarantee any specific outcome, including reduced screen time, improved focus, increased well-being, or habit change.
For consumers in the EU or UK, nothing in this section affects your statutory rights under applicable consumer protection law, including any right to a service that conforms to its description.
7. Intellectual Property
Align, including its software, design, branding, text, graphics, and other content, is owned by us or our licensors and is protected by applicable intellectual property laws.
Except as expressly permitted by law, you may not copy, modify, distribute, sell, sublicense, or create derivative works from the Service without our written permission.
8. Feedback
If you send us feedback, suggestions, or ideas about Align, you grant us the right to use them without restriction or compensation to you.
9. Subscriptions, Trials, and Billing
Align offers auto-renewing paid subscriptions processed through Apple's App Store. The following terms apply to all purchases made through Align.
Free trial. Align may offer eligible new subscribers a free trial on selected subscription plans. Trial availability and duration are shown before purchase. If offered, the trial begins at the time of purchase confirmation. Any unused portion of the trial period is forfeited immediately upon purchase of a paid subscription.
Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or yearly, depending on the plan you select) unless you cancel at least 24 hours before the end of the current period. Renewal is charged to your Apple ID account within 24 hours before the end of the current period.
Billing. Payment is charged to your Apple ID account at confirmation of purchase. Prices are shown in your local currency at the time of purchase.
Managing or cancelling. You may manage your subscription and turn off auto-renewal at any time through your Apple ID Account Settings in the App Store. Cancellation takes effect at the end of the current billing period; you retain access until that date.
Refunds. All refund requests must be directed to Apple. We do not process refunds directly. To request a refund, visit Apple's support at reportaproblem.apple.com.
EU right of withdrawal. If you are an EU consumer, you have a statutory 14-day right of withdrawal from digital content purchases. By confirming your subscription and requesting immediate access to Align's paid features, you acknowledge that delivery begins immediately and that you waive your right of withdrawal once the service has commenced, to the extent permitted by Apple's App Store terms and applicable law.
10. Suspension or Termination
You may stop using Align at any time by discontinuing use and uninstalling the app.
We may suspend or terminate access to the Service if:
- you violate these Terms
- continued operation becomes impractical, unlawful, or unsafe
- we decide to change or discontinue the Service
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIGN IS PROVIDED "AS IS" AND "AS AVAILABLE."
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
For consumers in the EU or UK, nothing in this section removes or limits statutory warranties or guarantees that cannot be excluded under applicable consumer protection law, including the EU Digital Content Directive (2019/770/EU) and the UK Consumer Rights Act 2015.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF ALIGN.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO ALIGN WILL NOT EXCEED:
- THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR
- USD $50 IF YOU PAID NOTHING
Nothing in these Terms limits or excludes our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded or limited under applicable data protection law, including GDPR Article 82 and CCPA § 1798.150; or (iv) any other liability that cannot be excluded or limited under applicable law.
13. Apple Requirements
These Terms are an agreement between you and Alisher Abdulin ("we"), not between you and Apple Inc. We, not Apple, are solely responsible for Align and its content. These Terms do not provide usage rules for Align that conflict with the Apple Media Services Terms and Conditions as of the effective date of these Terms.
License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use Align on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. Align may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where available and permitted by Apple.
Maintenance and support. We are solely responsible for providing maintenance and support for Align, as described in these Terms and as required by applicable law. Apple has no obligation to provide any maintenance or support services for Align.
Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event Align fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Align, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are solely our responsibility.
Product claims. We are solely responsible for addressing any claims by you or any third party relating to Align or your possession and use of Align, including: (i) product liability claims; (ii) any claim that Align fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property claims. In the event of any third-party claim that Align or your possession and use of Align infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim.
Legal compliance. You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
14. Changes to the Service and These Terms
We may modify, suspend, or discontinue part or all of Align at any time. We may also update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice in the app or on our website.
15. Governing Law
These Terms are governed by the laws of Kazakhstan, without regard to conflict-of-law principles.
For consumers in the European Union: mandatory consumer protection provisions of your country of residence apply in addition to Kazakh law, including but not limited to GDPR, the EU Consumer Rights Directive, and the EU Digital Content Directive. For consumers in the United Kingdom: UK consumer protection law, including UK GDPR, applies to the extent it cannot be contracted away.
